UPDATE: Death Investigation Continues at Nursing Home

State health officials backtrack, saying Sunday's fight that led to the death of an 80-year-old patient was in fact reported by the facility.

Update, Friday, 9:45 a.m. After originally disclosing that Oak Park Health Care didn’t report Sunday's violent incident — which would've been a violation of state law — the Illinois Department of Public Health said officials at the Oak Park facility did notify the agency by way of a fax.

Public health officials are continuing their investigation. Department spokeswoman Melaney Arnold said that process "typically takes weeks."

Original story: As police in Oak Park continue their investigation into the beating death of an 80-year-old patient at Oak Park Health Care, state health officials have some questions of their own.

A spokeswoman for the Illinois Department of Public Health told the Chicago Tribune Sunday's incident in which Anibal Calderon suffered massive head injuries after a fight with another patient should've been reported to the agency. It wasn't.

A nurse at Oak Park Health Care, 625 N. Harlem Ave., found Calderon unconscious sometime around 8:40 p.m. Sunday after an altercation with a fellow patient, authorities said. Calderon, who'd been a patient of the facility's Alzheimer/dementia ward, died at Rush Hospital in Chicago. His death ruled a homicide by the Cook County Medical Examiner's Office.

Sunday's incident far from the first time allegations of misconduct have surfaced at Oak Park Health Care.

According to Oak Leaves, the Illinois Department of Public Health carried out 122 formal complaint investigations at the facility in a ten-year stretch, from January 2001 to December 2011. The complaints included one resident who had both legs amputated after an untreated maggot infestation, the rape of a female resident by a male resident, allegations of verbal and mental abuse against a mentally ill patient and a mysterious death of an 88-year-old Alzheimer's patient in Dec. 2009.

The facility was compliant with state and federal regulations until failing to report Sunday's incident, the Tribune reported. Investigators from the IDPH are likely to continue their investigation at the facility throughout the week, according to Wednesday Journal.

Meanwhile, the unidentified 66-year-old man, who according to a police statement is "believed to be connected to the incident," has been removed from the facility and placed into a hospital, the Tribune reported.
